4.4.7 Sufficiency of the Contract Price (Silver Book) or Accepted Contract Amount (Yellow Book): Clause 4.11

In both Books the fixed-price lump sum is intended to be sufficient for the

works to be designed and executed as required by the contract and

the Contractor is meant to have taken steps to satisfy himself that this is so.

The Contractor in each Book is deemed to have satisfied himself as to the cor-

rectness and sufficiency of the Contract Price (Silver Book) or Accepted

Contract Amount (Yellow).

Unless otherwise stated in the contract, the Contract Price/Accepted Contract

Amount covers all the Contractor ’ s obligations under the contract (including

those under provisional sums, if any) and all things necessary for the proper

design, execution and completion of the works and the remedying of any defects.
